Terms & Conditions

  

These terms and conditions set out the basis on which you can use our website and place orders for items from Have to Love Active Limited online. By ordering goods from Have to Love Active Limited online you are deemed to have understood and accepted these terms.

 

The supplier of the goods featured is Have to Love Active Limited, (“HTLA”, “we”, or “us”). Our registered office is 2 Esh Plaza, Great Park, Newcastle upon Tyne, NE13 9BA. Our company registration number is 11622749 (England and Wales). Our store address is 3 Hawthorn Road, Gosforth, Newcastle upon Tyne, NE3 4DE. HTLA reserves the right to amend these terms and conditions at any time. Your statutory rights are not affected.

 

Orders and Contract

 

Your order for goods is accepted and a contract is formed between HTLA and you when we despatch the goods you have ordered and not before. A contract is not formed at the point in time that payment has been taken from you by HTLA or any third party, nor at the point in time that you receive an email from HTLA acknowledging receipt of your order.

 

Until the goods are despatched the order may not be accepted by HTLA or may be cancelled by you.

 

Following formation of the contract, HTLA shall continue to own any goods ordered until it has received payment in full from you, even though the goods may have already been delivered to you. Purchases from HTLA online will be charged the day the goods are despatched/purchased in-store.

 

Cancelling your order

 

Under Consumer Regulations you have the right to cancel your order as long as you do so no later than 14 days after the day on which you receive the goods or service. You must inform us of your wish to cancel in writing either by letter, email or telephone call on 0191 213 1155 within a period of 14 days beginning on the day after the day you receive your goods.

 

You must take reasonable care of the goods and not use them. You should return goods to us in their original packaging, wherever possible, within 14 days of informing us of your wish to cancel. If you return goods to us, we will not be responsible for any loss or damage to them during transit and we recommend that you use a recorded or secure delivery method. If goods are lost or damaged in transit, we may charge you, or not refund to you, amounts that are attributable to the loss or damage.

 

We cannot accept substitute or alternative items by way of returns nor are we able to send them back to you, so please look closely at the items you return to us. If you return or attempt to return substitute or alternative items you will still be responsible for paying for the original item purchased and we reserve the right to charge an investigation fee of no less than £35 to cover the cost of our investigating the position. We can offset this amount due from other sums that may be due to you for refunds. Accepting returned goods and/or crediting an account does not constitute a waiver of our right to charge an investigation fee.

 

Delivery Charges

 

For England, Scotland & Wales, next day delivery charge to home is £5.99 per delivery. The next day delivery service applies on orders placed Monday to Friday before 2.00pm. Orders placed after 2.00pm may not be dealt with until the following day. Orders placed on a Saturday will not be sent out for delivery until Monday. Next day delivery is via Royal Mail and will typical take 24 hours to deliver. 

 

For England, Scotland & Wales, standard courier delivery charge to home is £3.99 per delivery. The standard delivery service applies on orders placed Monday to Saturday before 2.00pm. Order placed after 2.00pm may not be dealt with until the following day. Orders placed on a Saturday will be not be sent out for delivery until Monday. Standard delivery is via Hermes and will typically take 2-4 working days to deliver.  

 

All courier delivery services are subject to stock, courier area and availability and demand. When the standard courier service is not available, HTLA will deliver by an alternative carrier and this may take longer. Delivery times cannot be guaranteed. No delivery services are available on a bank holiday. Delivery times cannot be guaranteed. Over our busy periods our standard delivery services may be affected.

 

Your delivery address

 

You must confirm your delivery addresses on your online order. Delivery to an alternate address is not available.  We reserve the right to refuse a delivery to an alternative address.

 

Returning to a Store

 

You may return most items in a new and unused condition and wherever possible in the original packaging. This service is available to our Gosforth store and is free of charge.

 

Returns Via Courier

 

You may return most items in a new and unused condition and wherever possible in the original packaging. If you want to cancel/return your order you must tell us within 14 days (beginning on the day after the day you receive the goods), and you then have 14 days to return the items.

 

Post

 

To return by post please send your items to:

 

3 Hawthorn Road, Gosforth, Newcastle upon Tyne, NE3 4DE and then take to your nearest Post Office.

 

Prices

 

The prices shown are exclusive of any value added tax or sales tax. Due to circumstances beyond our control, prices may have to be altered up or down, including any alterations to the rate of value added tax or sales tax. The current price will be shown when you place your order. All prices shown are cash prices in sterling. Prices of goods displayed online may differ from prices in our store.

 

Usage

 

All products are sold on the basis that they are suitable for domestic use only. Please contact us for further information if you intend using any products in a business or public environment.

 

Availability

 

All orders for clothing are subject to availability.

 

Colour of reproduction

 

HTLA take great care with the colours used in the collections. The limitations of colour reproduction and the individual colour settings of your screen may mean a slight variation. Every reasonable care has been taken to ensure that the descriptions are accurate. However, specifications may change.
